Spousal Sponsorship: Sponsoring a foreign spouse to Canada is a tedious process. It is really important that the different categories and definitions are understood before the application is put through. There are three different types of spousal sponsorships:
- Spousal Sponsorship: This is the simplest and most straightforward of all sponsorships. This type of sponsorship application is for married couples. The marriage can take place in any country as long it is performed according to the laws of the country. The immigration authorities will recognize the marriage as long as supporting documents like a valid marriage certificate can be provided.
- Common Law Partner Sponsorship: Common Law partnership is when a couple has been living in a marriage-like relationship. It is essentially treated like a married couple sponsorship for immigration purposes. The immigration authorities will expect to see evidence that the couple has been living together for at least one year, such as lease or rental agreements in both names.
- Conjugal Partner Sponsorships: This type of category is treated as an exception category and is probably the most difficult. This category can’t be treated as a fiancé visa for couple who intends to marry later on. Conjugal partners are two people who are in a marriage-like relationship but due to extenuating circumstances have not been able to marry or to live together continuously for a year so as to qualify as common-law. This could be as a result of visa barriers or other barriers to cohabitation.
Family Sponsorship: Family Sponsorship deals with immigration for relatives or other family members. Here are the relatives who might qualify under this category:
- Parents
- Grandparents
- Unmarried, dependent children under 22 years of age
- Adopted children (within Canada or outside of Canada)
- Orphaned siblings, nephews, nieces, grandsons, or granddaughters who are under 18 years of age, and unmarried (including common-law partners)
- Any other relative who has no other relative who can sponsor them
